Terms of Service

These Terms of Service ("Terms") govern your use of NecronomiComm (the "Service"). The Service is a web application that helps web developers and agencies ("you") find local businesses and organizations whose websites may benefit from modernization, by scoring publicly available signals about those websites. A paid account is referred to as a "Subscriber". By creating an account or using the Service, you agree to these Terms.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract. You are responsible for everything done under your account. Provide accurate information, keep your password secure, and tell us promptly of any unauthorized use.

2. What the Service does

The Service discovers businesses and organizations from public data, computes an automated "modernization score" from public website signals, and generates draft outreach materials (reports, action plans, and AI-assisted sales pitches). Scores and findings are automated estimates provided for research only. They may be incomplete or inaccurate, and are not a professional audit. Verify anything important — including whether a business truly has or lacks a website — before relying on it or contacting anyone.

3. Acceptable use

  • Use the leads and generated materials only for lawful business outreach.
  • Any email, call, or message you send is your responsibility. You must comply with all applicable anti-spam and privacy laws (e.g. CAN-SPAM, CASL, GDPR/ePrivacy), including honoring opt-outs and do-not-contact requests.
  • Do not use the Service to harass, defraud, or mislead anyone.
  • Do not scrape, overload, reverse-engineer, resell, or circumvent limits of the Service, or attempt to access data belonging to other users.

4. Accounts, free look, and subscriptions

A free account may run a limited number of scans per day with a redacted result, so you can confirm the leads are real before subscribing. Full features require a paid subscription. Subscriptions are billed through Stripe on a recurring monthly or yearly basis and renew automatically until cancelled. You can cancel at any time from the billing portal; cancellation stops future renewals and takes effect at the end of the current period. Except where required by law, fees already paid are non-refundable. Prices may change with notice for future billing periods.

5. Third-party services

The Service relies on third parties, each governed by its own terms: Stripe (payments), Google (sign-in and PageSpeed audits), Anthropic (AI-generated copy), an email delivery provider, and hosting/CDN providers. Business and location data is sourced from © OpenStreetMap contributors under the ODbL. We do not store your payment card details (Stripe handles those) and we do not ask you for any API keys.

6. Intellectual property

The Service, including the scoring engine, is owned by us and provided under a limited, revocable, non-exclusive license for your business use. The reports, action plans, and pitches you generate are yours to use with your own prospects and clients. Our name, logo, and branding remain ours.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that scores are correct, that leads are current, or that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe create legal or security risk. Sections that by their nature should survive termination (ownership, disclaimers, liability) continue to apply.

10. Changes to these Terms

We may update these Terms; when we do, we will change the version date above and, for material changes, provide reasonable notice. Continued use after an update means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which NecronomiComm is established, without regard to conflict of law rules.
